Help with covenant

Hello everyone,

I'm after some information regarding covenants. I'm moving into Bedlington (near the Bank Top Pub) next weekend and my solicitor found a covenant in a conveyance from the 1980s stating that there could not be any alteration to the exterior of the property without written permission from Wansbeck District Council. Well, my property has a wee conservatory at the back - which falls under Permitted Development, planning permission wise - but written permission from the council was never sought for it. I have taken out the Legal Indemnity Policy, so really I'm just asking out of sheer curiosity...does anyone know who you'd have to contact to get retrospective permission? I spoke to Northumberland County Council and was told Bernicia took over from Wansbeck District Council so I would have to get in touch with them? Like I say, I'm just being nosey really, but it's bugging me that I can't find anything out searching the internet and I'm normally quite good at that!

Anyway, thanks for any help!

Looks like the info you got is flawed minitoonmook, or its a case of comparing apples and pears.  

 

NCC took over all legal responsibilities when WDC was abolished.  

 

Bernicia is just a social housing provider and whilst they ended up with our old council houses they have no wider legal responsibility.   

 

So to me at least it would seem you need to be dealing with NCC as it is they who took on all covenants etc.  I am presuming, from what you have written,  you are buying your house and not renting off Bernicia?   

I would suggest trying to get indemnity off NCC in writing regarding this covenant.

Hi Malcolm,

Yep, I'm buying my first home! Very exciting... I would have thought NCC would be the obvious way to go too, maybe the lady who rang me assumed I was in social housing? I'm quite glad I just instructed my solicitor to get the legal indemnity cover as I now wouldn't trust any information the Council gave me.

Oh well, thank you both for your help anyway, I really do appreciate it :)

    • A big-hearted donation by one of South East Northumberland’s largest employers has enabled local football club, Bedlington Terriers FC, to provide its players, staff and visitors with rapid emergency response should it ever be needed.
      Lynemouth Power Station has gifted the community club with a life-saving heart defibrillator which will now be installed at the Welfare Park ground. If deployed within three to five minutes of a cardiac arrest, such equipment could potentially increase the chances of someone surviving a heart attack from six to 74 per cent. Each minute without CPR and defibrillation also reduces a patient’s survival rate by between seven and ten per cent.*
      The Northern League Division Two club is home to seven teams and over 80 footballers from senior players to an under 6 ‘tots’ team. Along with daily training sessions and match attendances, the club sees hundreds of people visiting the ground on a weekly basis therefore the defibrillator has been very well received by all.
      Rowan Edwards, Commercial Director of Bedlington Terriers FC, commented, “This is a vital piece of first aid equipment and we are extremely grateful to Lynemouth Power Station for their kind donation. Given the number of on-site staff, players training each week and visitors to the ground, it is essential that our trained staff have instant access to life-saving equipment in case of emergencies. It will mean a lot to everyone here at the club as well as the local community, so we’re very grateful for the power station’s support.”
      Janet Mole from Lynemouth Power Station added, “Having these devices installed in popular public places and venues is so important, so rather than just donate to the fundraising effort, we decided to purchase the equipment outright on behalf of the club. As a local employer, it is important that community initiatives like this are well supported so we’re delighted to hand over the defibrillator to all at the club.”
